DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                  ORDER AND OPINION REMANDING PROCEEDING ON APPEAL


          On January 26, 1987 the  above-named  petitioner-owner  filed  an
          Administrative Appeal against orders issued on December 22,  1986
          by the District Rent  Administrator,  92-31  Union  Hall  Street,
          Jamaica New York, concerning the housing accommodations known  as
          444 East 52nd Street, New  York,  New  York,  Various  Apartments
          wherein the District Rent Administrator  determined  the  owner's
          hardship application.

          The Administrative Appeal is being  considered  pursuant  to  the
          provisions of 9 NYCRR 2202.8.

          The Commissioner notes that in a related proceeding under  Docket
          Numbers SJR 5481, EI 430186 RO and EI 420141 RT,  also  involving
          an application for hardship rent increases for the subje t  rent-
          controlled apartments,  the  Commissioner  issued  an  order  and
          opinion on July 15, 1991 remanding the proceeding to the District 
          Rent  Administrator  for  a  further  accounting   review.    The
          contentions made by  the  owner  in  said  administrative  review
          proceeding  are  similar  to  those  asserted  in   the   instant
          proceeding.

          It is the opinion of the Commissioner that the instant proceeding 
          should  be  remanded  to  the  District  Rent  Administrator  for
          consolidation with the proceeding remanded pursuant to the  order
          of July 15, 1991 and for appropriate further consideration.


          THEREFORE, in accordance with the  provisions  of  the  Rent  and
          Eviction Regulations for New York City, it is

          ORDERED, that this administrative appeal be, and the same  hereby
          is, granted to the extent of remanding  this  proceeding  to  the
          District Rent Administrator for further processing in  accordance
          with this order and opinion.  The orders  of  the  District  Rent
          Administrator remain in full force and effect  until  new  orders
          are issued on remand.
