ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On April 1, 1987, the above-named petitioner-owner filed a Peti-
tion for Administrative Review of an order issued on March 17,
1987, by the Rent Administrator, 93-31 Union Hall Street,
Jamaica, New York, concerning the housing accommodations, known
as Apartment 6-H at 2805 Heath Avenue, Bronx, New York.
This proceeding was commenced on September 15, 1984 with the
filing of a tenant's objection to Rent/Services Registration.
The tenant commenced occupancy on August 1, 1983 pursuant to a
three-year lease, at a rental of $385.00 per month.
In his complaint, the tenant claimed, among other things, that
the rent being paid was an overcharge.
The owner was served with a copy of t e complaint and was re-
quested to submit rent records to prove the lawfulness of the
rent being charged. In answer, the owner submitted the required
By order dated March 17, 1987, the Rent Administrator established
the lawful stabilized rent, determined that the tenant had been
overcharged, and directed the owner to refund overcharges of
$5,990.96, including interest on over-charges collected in or
after April 1, 1984, to the tenant.
In its petition for administrative review, the owner alleges that
there has been no rent overcharge.
The Commissioner is of the opinion that this petition should be
The Commissioner finds that the owner raises no substantive
argument or no issue of law or fact that would provide a basis
for disturbing the Administrator's order, but merely submits an
unsupported allegation that there has been no rent overcharge.
THEREFORE, in accordance with the Rent Stabilization Law and
Code, it is
ORDERED, that this petition be, and the same hereby is, denied,
and that the Rent Administrator's order be, and the same hereby
