                       ORDER AND OPINION DENYING PETITION FOR
                                ADMINISTRATIVE REVIEW


          On June 16, 1986 the above-named petitioner timely refiled an 
          appeal, which had been rejected under Docket Number ART 10091-L, 
          against an order issued on April 7, 1986 by the Rent Administrator, 
          92-31 Union Hall Street, Jamaica, New York concerning the housing 
          accommodation known as apartment 7R, 344 West 72nd Street, New 
          York, New York wherein the Administrator directed the owner to 
          restore certain services but determined that a rent reduction was 
          not warranted.

          The tenant initiated this proceeding by filing a complaint of 
          diminution of services.  The tenant requested a rent reduction.

          After a staff member of the DHCR conducted a physical inspection, 
          the Administrator determined that laundry room services were not 
          being provided by the owner.

          In the order here under review, the Administrator determined that 
          there had been a diminution of services and directed the owner to 
          restore the service to the required level.  However, based on the 
          evidence, the Administrator determined that a rent reduction was 
          not warranted.

          In the appeal, the tenant seeks to modify the Administrator's order 
          to include the requested rent reduction.

          Although afforded the opportunity to do so, the owner did not 
          respond to the petition.

          After careful consideration, the Commissioner is of the opinion 
          that this petition should be denied.


          Subsequent to the order's issuance the Division's Compliance

          Bureau initiated procedures to assure the owner's compliance with 
          the Administrator's directive.  Nevertheless, the owner failed to 
          comply.  Upon the finding of a decrease in services, a rent 
          reduction was mandated.  Accordingly, on December 24, 1986, in an 
          order issued by the Compliance Bureau, the rent for the subject 
          apartment was reduced to the level in effect prior to the most 
          recent guidelines increase effective retroactively to July 1, 
          1985, the first of the month following service upon the owner of 
          a copy of the tenant's complaint.  Therefore, the tenant's appeal 
          for a rent reduction is moot.

          THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, it is

          ORDERED, that this petition be, and the same hereby is, denied 
          and the Rent Administrator's order be, and the same hereby is, 
          affirmed.
