  ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                                
      On  May  14, 1986 the above named petitioner-owner filed  a
Petition  for Administrative Review against an Order of the  Rent
Administrator  issued May 1, 1986.  The order  concerned  housing
accommodations  known as Apt. 2 located at 261-65  Langston  Ave.
Glen  Oaks,  N.Y. wherein the Administrator granted  the  owner's
application for rent restoration.

      The  Commissioner  has reviewed the  record  and  carefully
considered  that portion relevant to the issues  raised  by  this
appeal.

     The owner commenced this proceeding by filing an application
to  restore  rent On May 25, 1985.  It claimed that services  for
which an order reducing rent (see Docket No. Q-001752 B) had been
issued  were  restored.  The Administrator's order  restored  the
rent effective May 1, 1986.

       On  appeal  the  tenant  asserts  that  the  owner's  rent
restoration   application  was  erroneously   granted   and   the
Administrator's order should be revoked.

      After  careful  review of the evidence in the  record,  the
Commissioner  is  of  the  opinion that the  petition  should  be
denied.

      A  review of the available evidence of record reveals  that
the  rent  was properly restored.  The Administrator's order  is,
therefore, affirmed.
           THEREFORE, pursuant to the Rent Stabilization Law  and
Code, it is

      ORDERED,  that  this petition be, and the same  hereby  is,
denied, and that the Rent Administrator's order be, and the  same
hereby is, affirmed.
