ORDER AND OPINION TERMINATING PROCEEDING
The above-named petitioner-tenant timely refiled a petition for
administrative review against an order issued on March 19, 1986, by
a Rent Administrator, Gertz Plaza, Jamaica, New York, concerning
housing accommodations known as apartment 3 located at 1364 York
Avenue, New York, New York, wherein the Administrator, had granted
the owner's application for an increase in the legal regulated rent
for the subject apartment of $19.28 per month based upon the
owner's installation of a new fire resistant door.
The Commissioner finds that subsequent to the filing of this
Petition, the tenant vacated the subject apartment and, in response
to the Division's inquiry as to the status of the underlying
dispute, the tenant's attorney advised the Division that there is
no longer an active issue to be resolved and the petitioner wishes
to withdraw the Petition.
Therefore, the Commissioner finds that the proceeding brought
on by the filing of the instant Petition and assigned Docket Number
ART09885L should be terminated as withdrawn.
THEREFORE, pursuant to all of the applicable statutes and
regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
