                       ORDER AND OPINION REMANDING PROCEEDING ON APPEAL

               On October 23, 1985 the abovenamed petitioner tenant filed  a
          Petition for Administrative Review  against  an  order  issued  on
          October 9, 1985 by the Rent Administrator  concerning the  housing
          accommodations known as 5421 Sylvan Avenue, Apartment  1H,  Bronx,
          New York.
               
          The herein appealed order of the Rent Administrator terminated the 
          proceeding based on the apparent failure of the tenant to  respond
          to a notice requesting the name and address  of  the  landlord  or
          managing agent.

          In her petition the tenant alleges that she did, in  fact,  timely
          respond to the Administrator's  notice  submitting  a  copy  of  a
          registered mail receipt.

          The Commissioner is of the opinion that the proceeding  should  be
          remanded for futher processing.    

          Since the tenant  did  submit  the  required  information  but  it
          apparently did not reach the record, the matter should be remanded 
          to consider the tenant's service complaints on the merits.

          Notice should be given  to  all  parties,  including  the  current
          owner, and the tenants permitted to supplement her  complaint,  if
          warranted, with notice to the owner.  Inquiry should also be  made
          as to the current status of the building.

          THEREFORE, pursuant to the Rent Stabilization Law and Code, it is

          ORDERED, that this proceeding be, and the same hereby is,  granted
          to  the  extent  of  remanding  this  proceeding   to   the   Rent
          Administrator for further  processing  in  accord  herewith.   The
          order of the Rent Administrator is hereby revoked.
