             ORDER AND OPINION GRANTING ADMINISTRATIVE APPEALS, IN PART,
               AFTER RECONSIDERATION PURSUANT TO COURT ORDER; REVOKING PRIOR 
           ORDERS OF THE COMMISSIONER; AND MODIFYING PRIOR DISPOSITION OF 
                           THE DISTRICT RENT ADMINISTRATOR
                                          

          On April 10 &  15,  1986,  respectively,  the  petitioners  filed
          separate Administrative Appeals against an order issued on  March
          14, 1986, by the District Rent Administrator (10 Columbus Circle, 
          New York, New York) concerning the housing accommodation  located
          at 295 West 11th Street, New York, New  York,  Apartment  No.  4B
          wherein the District Rent Administrator established a fair market 
          rent for the said accommodation.

          The Commissioner issued orders on November 25,  1986,  dismissing
          the owner's  petition  and  on  December  5,  1986,  denying  the
          tenant's petition.

          The  parties   thereafter   sought   judicial   review   of   the
          Commissioner's orders in the Supreme Court pursuant to Article 78 
          of  the  Civil  Practice  Law  and  Rules  requesting  that   the
          Commissioner's order disposing of their respective  petitions  be
          annulled.

          On July 13, 1987,  an  order  was  signed  by  Justice  Helen  E.
          Friedman incorporating the Stipulation of Settlement executed  by
          the parties herein.  Pursuant to the said agreement and the order 
          of the Supreme Court, the parties released each other of any  and
          all claims arising out of these proceedings and agreed  with  the
          sanction of the Court, that the initial legal rent of the subject 
          accommodation as of March 1,  1984,  the  date  upon  which  this
          tenancy commenced, be $350.00 per month; that the  lease  renewal
          rent as of March 1, 1986, be $372.75  per  month;  and  that  all
          pending proceedings under District Rent Office Docket Numbers
          L 3114704-R; LS 000165-B; LS 000165-R/G; 1500165-R and
          PL 005630-R are to be withdrawn.

          Pursuant to  the  aforesaid  Order  of  the  Supreme  Court,  the
          Commissioner deems it  appropriate  that  the  proceedings  under

          Administrative Appeal Docket Numbers ART 09464-L and ARL  09508-L
          be, and the same hereby are reopened for reconsideration and upon 
          such reconsideration to give effect to the order of  the  Supreme
          Court by adopting the legal rent and the terms and conditions  of
          the settlement agreement  of  the  parties  as  provided  in  the
          stipulation and approved by the Supreme Court.

          Accordingly, the Commissioner's prior orders of November 25, 1986 
          and December 5, 1986 should be  revoked  and  the  District  Rent
          Administrator's order of  March  14,  1986  under  District  Rent
          Office Docket Number 23226, should be modified as hereinabove set 
          forth.  The five proceedings under  the  dockets  listed  in  the
          stipulation which  the  tenant  agreed  to  withdraw  are  hereby
          terminated if still pending and if orders have been issued  which
          are contrary to the within settlement, they  are  hereby  vacated
          and set aside and  the  District  Rent  Administrator  is  hereby
          directed to make appropriate disposition of the said  proceedings
          and enter the same upon the records of the District  Rent  Office
          for the subject accommodation.

          THEREFORE, in accordance with  the  Rent  Stabilization  Law  and
          Code, and the  Emergency  Tenant  Protection  Act  of  1974,  and
          Chapter 403 of the Laws of 1983, as amended by Chapter 102 of the 
          Laws of 1984, as implemented by Operational Bulletin 84-1, it is

          ORDERED, that the Commissioner's prior  orders  of  November  25,
          1986 and December 5, 1986, be, and the same  hereby  are  revoked
          and the District Rent Administrator's order of  March  14,  1986,
          be, and the same hereby is modified  by  establishing  the  legal
          rent for the subject accommodation at $350.00  per  month  as  of
          March 1, 1984, and at $372.75 per month as of March 1,  1986  and
          it is further
           
          ORDERED, that the terms and  conditions  of  the  stipulation  of
          settlement executed by the parties and adopted by the  Court  be,
          and the same hereby are, incorporated in this order.
