             ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

         The above-named petitioner-tenant filed a timely petition for 
         administrative review of an order relating to the above described 
         docket number, concerning housing accommodations known as Apartment 
         2N, 2415 Newkirk Avenue, Brooklyn, New York, wherein the Administrator 
         determined that the owner was entitled to a rent increase based on 
         major capital improvements.

         In this petition the tenant contends in substance, that the rent 
         granted exceed the statutory limitation on collectibility.

         The Commissioner is of the opinion that this petition should be 
         denied.

         The rent increase authorized by the Administrator is subject to a six 
         percent annual limitation on collectibility of permanent MCI increases 
         with a similar limitation on temporary arrears (whether or not these 
         increases are collected on their own or in addition to any previous 
         MCI increase granted).  In the event that the owner herein exceeds 
         these limits it may be liable for any rent overcharge if rent 
         overcharge complaints are filed by the tenants.

         On the basis of the entire evidence of record, it is found that the 
         Administrator's order was correct and should be affirmed.

         THEREFORE, in accordance with the applicable provisions of the Rent 
         Stabilization Code, it is

         ORDERED, that this petition be, and the same hereby is, denied; and 
         that the Administrator's order be, and the same hereby is affirmed.
