            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


               On  September  11,  1986  the  above-named  petitioner-owner
          timely refiled a Petition for Administrative  Review  against  an
          order issued on July 9, 1986 by a Rent  Administrator  concerning
          the housing accommodation known as Apartment No. 10-A,  601  West
          160 Street, New York, NY, wherein  the  Administrator  determined
          that the owner had not restored conditions to the required level.

               The Commissioner has reviewed all of  the  evidence  in  the
          record and has carefully considered that portion  of  the  record
          relevant to the issues raised by the administrative appeal.  

               The record reveals that an order was issued on May 23,  1986
          under docket number US 001126-S directing the owner to  repair  a
          hole around the riser on the floor and the  falling  plaster  and
          peeling paint condition throughout the bedroom.  A rent reduction 
          was not ordered. 

               The owner's restoration application was denied in the  order
          appealed herein based on a physical inspection of the premises on 
          June 10, 1986 which revealed that painting repairs have not  been
          made to the walls, ceilings and windows. 




               In the petition for administrative review, the owner asserts 
          that significant work was done in the subject apartment and  that
          all work  was  completed  before  the  purported  June  10,  1986
          inspection.

               After  careful  consideration  of  the  entire  evidence  of
          record, the Commissioner is of  the  opinion  that  the  petition
          should be denied.

               The Administrator's order was based  on  the  results  of  a
          physical inspection which revealed that  the  necessary  painting
          services had not been restored.  The owner has not submitted  any
          evidence to establish that the order is in error. 

               THEREFORE,  in  accordance  with  the  Rent   and   Eviction
          Regulations for New York City, it is

               ORDERED, that this petition be and the same hereby is denied 
          and the Administrator's order be and the same hereby is affirmed.
