           ORDER AND OPINION REMANDING PETITION FOR ADMINISTRATIVE REVIEW

          On May 23, 1986 the above-named petitioner-owner filed a Petition 
          for Administrative Review against an order issued on May 14, 1986 
          by the Rent Administrator, 99 Church Street, White Plains, 
          New  York  concerning  the  housing   accommodations   known   as
          180 Pinewood Road, Apartment-7, Hartsdale, New York  wherein  the
          District  Rent Administrator determined that  an  overcharge  had
          been collected and imposed a penalty of treble damages.

          This appeal has been considered in conformity with the applicable 
          provision of the laws of 1983 (omnibus Housing Act of  1983),  as
          amended, but in the `opinion of the Commissioner,  he  record  is
          not adequate to form the basis for a proper determination of  the
          issues  in  the  proceeding.    Specifically,   the   record   is
          insufficient to establish whether the  owner  was  notified  that
          possible overcharge penalty was the imposition of treble damages. 
          The  proceeding  must  therefore  be   remanded   to   the   Rent
          Administrator for further consideration.

          THEREFORE, in accordance with the provisions of Chapter 403  Laws
          of 1983 as amended by  Chapter  102  of  the  Laws  of  1984,  as
          implemented by Operational Bulletin 84-1, it is 

          ORDERED, that this Petition be, and the same hereby is, granted t 
          the extent of remanding this proceeding to the Rent Administrator 
          for further processing in accordance with the order and  opinion.






          The automatic stay of so much the Rent Administrator's  order  as
          directed a refund payment is  continued  until  a  new  order  is
          issued upon remand.  However, the  Administrator's  determination
          as to the lawful stabilization  rent  is  not  stayed  and  shall
          remain in effect until the Administrator issues a new Order  upon
          remand.
