ORDER AND OPINION TERMINATING THE PROCEEDING
On May 15, 1986 the above-named owner refiled a petition for
administrative review of an order issued on March 27, 1986 by a
District Rent Administrator concerning the housing accommodation
known as Apartment 8, 218 East 111th Street, New York, New York,
in which the Administrator vacated the owner's Report of
Statutory Decontrol on the ground that the subject apartment had
not become vacant on or after June 30, 1971.
The Division's records reveal that the subject apartment has been
registered as a rent stabilized apartment since 1986 with the
same tenant in occupancy since February 1, 1985. The Division's
records also reveal that there are not and have not been any
proceedings filed with the Division of Housing and Community
Renewal (DHCR) by this tenant. It is also noted that the present
occupant is a different tenant than that named in the
Administrator's order.
Accordingly, the Commissioner finds that there is no longer an
active issue to be resolved in this proceeding.
THEREFORE, in accordance with the Rent and Eviction Regulations
for New York City, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
