ORDER AND OPINION REMANDING THE PROCEEDING
TO THE RENT ADMINISTRATOR
On May 16, 1986 the above-named owner filed a petition for
administrative review of an order issued on April 21, 1986 by a
District Rent Administrator concerning the housing accommodation
known as Apartment 3B, 60 East 12th Street, New York, New York.
This appeal has been considered in conformity with the applicable
provisions of law, but in the opinion of the Commissioner, the
record is not adequate to form the basis for a proper
determination of the issues in this proceeding. The proceeding
must therefore be remanded to the Rent Administrator for further
consideration.
THEREFORE, in accordance with the Rent Stabilization Law and
Code, the Rent and Eviction Regulations, and the Emergency Tenant
Protection Act of 1974, it is
ORDERED, that this proceeding be, and the same hereby is,
remanded to the Rent Administrator for further processing in
accordance with this Order and Opinion.
