               ORDER AND OPINION TERMINATING PROCEEDING AS PREMATURE


          On April 5, 1990, the above-named petitioner  filed  a  Petition  for
     Administrative Review concerning the housing accommodations  known  as  44
     West 63rd Street, Apartment 338 Manhattan,  against  an  Order  issued  on
     February 25, 1986 by the New York City Department of Housing  Preservation
     and Development (HPD).

          A Petition for Administrative Review (PAR) is an appropriate  vehicle
     for appealing Orders by the Division of Housing and Community  Development
     only.

          The instant PAR was filed against an order issued by HPD, a different 
     Agency which has its own appeal procedures.

          Consequently,  the  instant  PAR  must   be   terminated   as   being
     inappropriate.
