            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW

               On March 5, 1986 the  abovenamed  petitioner  owner  filed  a
          Petition for Administrative Review  against  an  order  issued  on
          February 4,  1986  by  the  Rent  Administrator  of  the  Brooklyn
          District Rent Office concerning the housing  accommodations  known
          as 272 Henry Street, Apartment B1, Brooklyn, New York.

               The herein appealed order of the Rent Administrator increased 
          the subject stabilized rent to reflect the installation of  a  new
          stove.

               In its petition the owner urges that the rent increase should 
          have been effective as of the date the stove was  installed  since
          the tenant consented to it.
                                                    
               No response was received from the tenant.

               The Commissioner is of the opinion that the  petition  should
          be granted.

               Since the apartment was stabilized  rather  than  controlled,
          the rent increase should be effective as of the first rent payment 
          date after  installation  and  the  Administrator's  order  is  so
          modified.

               THEREFORE, pursuant to the Rent Stabilization Law  and  Code,
          it is

               ORDERED, that this petition  be,  and  the  same  hereby  is,
          granted and that the order of the Administrator be, and  the  same
          hereby is, modified as above set forth.  The tenant, if  still  in
          occupancy as a tenant, may pay any arrears resulting  herefrom  in
          12 equal monthly installments.
