                      ORDER AND OPINION TERMINATING PROCEEDING

               On December 22, 1986, the above-named owner filed a petition 
          for administrative review of an order issued on December 15, 1986 
          by a Rent Administrator concerning various housing accommodations 
          in the premises known as 95 Christopher Street, New York, New York.

               In the order under review herein, the Administrator stated 
          that:

                    The Fuel Cost Adjustment (for 1980)
                    was revoked under Docket 3ADFC-1113
                    for landlord's failure to submit 
                    evidence as requested by Audit.  
                    Further reports which were filed by
                    the landlord for the year 1983/84 do 
                    not indicate that any fuel costs 
                    increase is warranted.

               The owner's petition asserts, among other things, that it did 
          not collect fuel cost rent adjustments for the years 1980-1982,
          pursuant to the Administrator's order of revocation; that the 
          Administrator mailed to the building's prior owner a "Request for 
          Additional Information," which stated that the fuel cost adjustment 
          would be revoked for a one-year period after which it would be 
          restored at $4.20 per room; that the owner states that, "the 
          landlord had filed the 1983 and 1984 Fuel Cost Adjustments timely, 
          showing that the reinstated amount was $4.20 per room"; that the 
          owner agrees that there is no fuel cost rent increase warranted for 
          1983-1984, and that the order under review herein should be 
          modified to show that the 1983 and 1984 fuel cost adjustment 
          reports were filed properly.

               After careful consideration, the Commissioner is of the 
          opinion that this proceeding should be terminated.

               The Commissioner notes that by a subsequent order issued on 
          February 9, 1987 by the District Rent Administrator under Docket 
          No. AD420006RP (CPTX3339), the Administrator stated that:  "Our 
          records indicate that the fuel-cost adjustment, from January 1, 
          1980 through December 31, 1985 inclusive, was $0.00.  In view of 
          foregoing, no further action is warranted."

               The record reflects that the Commissioner issued an order on 
          February 19, 1993, under Docket No. BC420546RO, which dismissed the 
          owner's petition of the above-mentioned Administrator's order 
          (AD420006RP). 

               The Commissioner finds that the Administrator's order under 
          Docket No. AD420006RP is a final determination of the rent agency.  
          The Commissioner further finds that Docket No. AD420006RP 
          supersedes the Administrator's order under review herein.

               Accordingly, the Commissioner is of the opinion that the 
          instant proceeding should be terminated as moot.

               THEREFORE, in accordance with the City Rent and Rehabilitation 
          Law and the Rent and Eviction Regulations, it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
