             ORDER AND OPINION REMANDING PROCEEDING TO RENT ADMINISTRATOR

    On December 17, 1986, the above-named owner filed a petition for 
    administrative review of an order issued on December 2, 1986 by a District 
    Rent Administrator concerning the housing accommodation known as Apartment 3- 
    RW, 8 Spring Street, New York, New York.

    On September 28, 1984 the tenant filed an objection to the 1984 apartment 
    registration, asserting among other things that a stove and a refrigerator had 
    been omitted from the registration.  In its answer, the owner requested that 
    it be served with a complete copy of the complaint in order to answer.

    In the order under review, the Administrator found the owner 
    to be in default, and found that a stove and refrigerator were required.        
                                   
    In its petition, the owner again requests a complete copy of the complaint.

    The record indicates that the owner has not been served with a full copy of 
    the tenant's complaint.  Accordingly, the Commissioner is of the opinion that 
    the proceeding should be remanded for this purpose and for the issuance of a 
    new order dealing with the issue of the stove and refrigerator.  The 
    overcharge aspect of the tenant's complaint was dealt with in other 
    proceedings.
              
    THEREFORE, in accordance with the Rent Stabilization Law and Code, it is
              
    ORDERED, that this proceeding be, and the same hereby is, remanded to the Rent 
    Administrator forprocessing of the tenant's objection objection to the 1984 
    apartment registration dealing with the subject apartment's services on its 
    merits, and for the issuance of a new determination.
