                      ORDER AND OPINION TERMINATING PROCEEDING


               On  December  4,  1986,  the  above-named  owner  re-filed  a
          petition for administrative review of an order issued on  June  6,
          1986 by a District Rent Administrator concerning  various  housing
          accommodations located at 43-18 49th Street, Long Island City, New 
          York.  

               On July 15, 1986 the above-named owner  was  deemed  to  have
          filed a petition for administrative review of an order issued June 
          6, 1986 (reducing  the  rents  in  the  subject  building  due  to
          inadequate heat and hot water).  On July 31, 1986 the Commissioner 
          issued an order and  opinion  dismissing  the  proceeding  on  the
          grounds that the petition had not been timely filed.   

               Thereafter, by letter dated August 28, 1986, t e  petitioner-
          owner requested that the  July  31,  1986  order  and  opinion  be
          reviewed and reconsidered based upon an irregularity  in  a  vital
          matter.  The owner asserted that the petition  had  in  fact  been
          timely filed.  The Commissioner found that the petition  had  been
          timely filed on July 11,1986, and on September 24, 1986  a  notice
          of proposed order and opinion, reopening the administrative review 
          proceeding for further consideration, was issued.

               On June 20, 1988 the Commissioner issued an order and opinion 
          under Docket No. ARL 11646 Q denying the owner's petition  on  its
          merits.  

               A review of the record discloses that the instant petition is 
          actually a duplicate of the petition filed by the  owner  on  July
          11, 1986, and which  has  already  been  decided  on  its  merits.
          Accordingly,  the  Commissioner  is  of  the  opinion  that   this
          proceeding should be terminated as duplicative.




               THEREFORE, in accordance with the Rent Stabilization Law  and
          Code, the City Rent and  Rehabilitation  Law,  and  the  Rent  and






           
          Eviction Regulations, it is

               ORDERED, that this proceeding be, and  the  same  hereby  is,
          terminated.
