DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

     September 12, 1986 the abovenamed petitioner owner filed  a  Petition  for
     Administrator Review against an order issued on  August  8,  1986  of  the
     Rent Administrator concerning the housing accommodations known as 155 East 
     34th Street, Apartment 3H, New York.

     The herein appealed order of the Rent Administrator reduced the stabilized 
     rent to reflect loose,drafty and rotting windows  in  the  livingroom  and
     bedroom.  The order was based on a physical inspection conducted on May 6, 
     1986.

     In its petition the owner alleges  that  the  windows  had  been  repaired
     subsequent to the abovenoted inspection and prior to the issuance  of  the
     Administrator's order.

     In  response  the  tenant  alleges  that  the  repairs  were  partial  and
     ineffective.

     The Commissioner notes subsequent physical inspections conducted on  April
     28, 1987 and May 13,  1989  in  connection  with  proceedings  before  the
     Enforcement (14819-H  &  15162-HL)  and  Compliance  Units  confirmed  the
     tenant's allegations.  Subsequently on February  9,  1990  the  Compliance
     Unit by letter advised that the tenant had failed to appear at  a  hearing
     and sent rent restoration application forms to the owner.

     The Commissioner is of the opinion that the petition should be denied.

     Subsequent  physical  inspections,  which  carry  more  weight  than   the
     allegations of the parties, disclosed that services had not, in fact, been 
     restored.

     The owner has already been advised of  its  right  to  apply  for  a  rent
     restoration.

     THEREFORE, pursuant to the Rent Stabilization Law and Code, it is

     ORDERED, that this petition be, and the same hereby is,  denied  and  that
     the order of the Rent Administrator be,a nd the same hereby is, affirmed.
