       AN  ACT  to  amend  the  administrative code of the city of New York, in
         relation to establishing a  minimum  base  rent  for  certain  housing
         accommodations

         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section 1. The administrative code of the city of New York is  amended
    2  by adding a new section 26-416 to read as follows:
    3    S  26-416  MINIMUM  BASE  RENT.  AS OF OCTOBER FIRST, NINETEEN HUNDRED
    4  NINETY-SEVEN, ACCOMMODATIONS IN CLASS A MULTIPLE DWELLINGS, WITH  TWENTY
    5  UNITS  OR  LESS,  SHALL  HAVE  A MINIMUM BASE RENT OF FOUR HUNDRED FIFTY
    6  DOLLARS PER MONTH, EXCLUDING GAS AND ELECTRIC UTILITY CHARGES.
    7    (A) THOSE TENANTS ELIGIBLE FOR RENT INCREASE  EXEMPTIONS  PURSUANT  TO
    8  SECTION  26-605  OF  THIS  CODE  ARE  EXEMPT FROM THE PROVISIONS OF THIS
    9  SECTION.
   10    (B) HOUSING ACCOMMODATIONS IN CLASS A MULTIPLE DWELLINGS  WITH  TWENTY
   11  UNITS  OR  LESS,  WHICH  CURRENTLY RENT FOR LESS THAN FOUR HUNDRED FIFTY
   12  DOLLARS PER MONTH, SHALL RECEIVE INCREASES OF FIFTEEN PERCENT  PER  YEAR
   13  UNTIL THE MINIMUM BASE RENT IS MET.
   14    S  2.  The  administrative  code of the city of New York is amended by
   15  adding a new section 26-520.1 to read as follows:
   16    S 26-520.1 MINIMUM BASE RENT. AS OF OCTOBER  FIRST,  NINETEEN  HUNDRED
   17  NINETY-SEVEN,  ACCOMMODATIONS IN CLASS A MULTIPLE DWELLINGS, WITH TWENTY
   18  UNITS OR LESS, SHALL HAVE A MINIMUM BASE  RENT  OF  FOUR  HUNDRED  FIFTY
   19  DOLLARS PER MONTH, EXCLUDING GAS AND ELECTRIC UTILITY CHARGES.
   20    (A)  THOSE  TENANTS  ELIGIBLE FOR RENT INCREASE EXEMPTIONS PURSUANT TO
   21  SECTION 26-605 OF THIS CODE ARE  EXEMPT  FROM  THE  PROVISIONS  OF  THIS
   22  SECTION.

    1    (B)  HOUSING  ACCOMMODATIONS IN CLASS A MULTIPLE DWELLINGS WITH TWENTY
    2  UNITS OR LESS, WHICH CURRENTLY RENT FOR LESS  THAN  FOUR  HUNDRED  FIFTY
    3  DOLLARS  PER  MONTH, SHALL RECEIVE INCREASES OF FIFTEEN PERCENT PER YEAR
    4  UNTIL THE MINIMUM BASE RENT IS MET.
    5    S  3. This act shall take effect immediately; provided that the amend-
    6  ments to the city rent and rehabilitation law made  by  section  one  of
    7  this  act  shall  remain  in  full  force and effect only so long as the
    8  public emergency requiring the regulation  and  control  of  residential
    9  rents and evictions continues, as provided in subdivision 3 of section 1
   10  of  the  local emergency housing rent control act; and provided that the
   11  amendments to the rent stabilization law of nineteen hundred  sixty-nine
   12  made  by  section  two of this act shall expire on the same date as such
   13  law expires and shall not affect the expiration of such law as  provided
   14  under section 26-520 of such law.
